Individual Home Buyer Referral Program Information
We at Providential Custom Homes (“PCH”) believe that there is no better form of advertisement than word of mouth. That’s why we offer a 1% referral fee to anyone who brings us a new home buyer.
For example, if the initial contract price is $500,000, then PCH would pay the referring party a 1% referral fee, which in the example would equal $5,000.00. Terms and Conditions apply.
The Program is simple and here are the rules:
#1What constitutes a Referral? A referral occurs when you bring or refer a customer to PCH and such customer signs a contract and actually closes on the purchase of a speculative home from PCH or signs a contract with PCH to build a new home.
#2Notification of Referral. PCH must be notified that you are referring a customer to us. As soon as you have someone who’s interested, you must contact PCH by email so we have record of the prospective client’s contact information as having been referred by you. If you fail to advise us of the referral before a contract is signed between PCH and the prospective client, you will not be entitled to a referral fee.
#3Registration of Referrals. You must register your contacts with us by simply emailing to email@example.com list of prospective clients whom you feel would be interested. We will then do all the follow up and pursue the selling aspects of the project with the prospective client. Be sure to include names, email addresses, and most importantly all phone numbers. Your referrals will be held on file indefinitely for use now or in the future.
#4Calculation of Referral Fee. The Referral Fee will equal one percent of the Total Contract Price identified in the New Home Contract and/or Residential Construction Contract, as applicable, between PCH and the prospective client exclusive of lot costs, change orders, allowance overages, the builder’s fee, closing costs, and realtor commissions.
#5Payment of Referral Fee. Everyone involved in the building business gets paid when the deal closes so you will be paid in the same manner. Payment of the Referral Fee will be made on the condition that the prospective client (i) closes and funds the purchase of a speculative home from PCH or (ii) executes a Residential Construction Contract with PCH, PCH is paid all sums due under such contract, and PCH reaches substantial completion of the project. Upon the occurrence of such conditions, PCH will pay the Referral Fee with ten business days thereafter.
#6No Pass Through of Cost to New Customer. Please be advised that PCH does not “add” Referral Fees to the cost of any project, so there is no additional cost to any prospective client of PCH. We pay these fees directly out-of-pocket at our own expense. Your friends and customers can rest assured they are not paying more for their home as a result of you earning the Referral Fee on their project.

Remember, any money you earn is taxable so we will need your tax information - name, address and social security number prior to receiving your referral fee. You will receive a 1099 Misc. Income Form at the end of the year.

All references herein to Providential Custom Homes shall mean Providential Land Development, L.P. d/b/a Providential Custom Homes. Any conflicts in the interpretation of this Program shall be resolved by PCH in its absolute and sole discretion. Your eligibility for a Referral Fee is subject to your compliance with these Terms and Conditions. If you fail to register a referral before such customer signs a contract with PCH, you waive all rights to the Referral Fee. If more than one person refers a prospective client(s), the first person to refer such client will be entitled to the Referral Fee.
You must provide true, accurate and complete information in the notification. If we determine that any information provided by you in your notifications was false or misleading, you will not be entitled to the Referral Fee. Persons who submit, directly or indirectly, fraudulent or duplicative claims for a Referral Fee will forfeit their rights to any Referral Fee and will be ineligible to participate in the Program.
You are responsible for all taxes associated with the Referral Fee. The Referral Fee Program, and any obligation of PCH under such Program, is subject to any limitations or restrictions imposed by applicable law. The Referral Fee Program is void where prohibited and in such event, you will not be entitled to any Referral Fee.
PCH’s obligation to pay you a Referral Fee is subject to PCH’s receipt of the Total Contract Price identified in the applicable contract with the prospective client. PCH reserves the right to modify, amend or terminate these Terms and Conditions at any time. Any such modification, amendment or termination shall be deemed effective upon the date of posting of notice of such modification, amendment or termination at PCH’s website www.breathlesshomes.com and shall apply to any and all affected transactions occurring after such date. It is your responsibility to check these Terms and Conditions, as may be amended from time to time, each time you conduct transactions subject to these Terms and Conditions.
LIMITATION OF LIABILITY.IN NO EVENT SHALL PCH OR ANY PERSON OR ENTITY AFFILIATED WITH IT BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE REFERRAL FEE PROGRAM, WHETHER LIABILITY IS ASSERTED IN CONTRACT OR IN TORT (INCLUDING STRICT LIABILITY OR NEGLIGENCE) OR OTHERWISE AND REGARDLESS OF WHETHER PCH OR ANY SUCH AFFILIATED PERSON OR ENTITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU CONTEST WHETHER A REFERRAL FEE IS DUE OR THE AMOUNT OF THE FEE TO BE PAID, RESOLUTION OF SUCH DISPUTE SHALL BE RESOLVED BY PCH IN ITS ABSOLUTE AND SOLE DISCRETION. THE MAXIMUM AMOUNT OF PCH’S LIABILITY UNDER THIS PROGRAM, REGARDLESS OF THE CAUSE OF ACTION ASSERTED, SHALL BE 1% OF THE APPLICABLE TOTAL CONTRACT PRICE, EXCLUSIVE OF LOT COSTS, CHANGE ORDERS, ALLOWANCE OVERAGES, THE BUILDER’S FEE, CLOSING COSTS, AND REALTOR COMMISSIONS.
THESE TERMS AND CONDITIONS OF OFFER AND THE REFERRAL FEE PROGRAM SHALL BE GOVERNED BY AND SUBJECT TO THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO THE CONFLICTS OF LAW PRINCIPLES THEREOF.
